Can slogans and phrases actually be copyrighted? To my knowledge, they can't.

Anyway, wouldn't it be nice if a credit card like that actually existed?

I did some research on this and found something interesting: a phrase cannot be copyrighted. However, it can be trademarked. And I have to good examples of that.

1) The 'Metallica' incident. The band claimed only they had the right to use the name and sued a lipstick company for inventing a lipstick with that same name. I believe the band lost, because using the name wouldn't lead to any confusion or conflicting interests (music and lipstick are two very different things).

2) The 'Rhapsody' incident. The name was both used for a music-related site (I think it sells music online or something like that) and a band (which I highly admire). The band eventually got told that they could no longer sue their name because the site got the name first. The band had to change their name (though the band apparently was allowed to slightly modify it instead of making a whole new one).

There's one of the US Navy being confronted by Paramount Studios concerning the name USS ENTERPRISE. The US Navy told Paramount basically to get bent seeing as they had been using the name since the mid 1700's. Paramount backed off

I'm sure most people will think of the fictional ship with that name and not so much the Navy one (at least here in Europe anyway), so Paramount's argument is a bit moot. They're lucky enough that the Navy doesn't really care about them using the name.
